Colette acted for the Claimant in various proceedings involving a freezing injunction made in support of Scottish proceedings pursuant to s. 25 of the Civil Jurisdiction and Judgments Act 1982, with alleged damages amounting to €85 million. This included successful contempt proceedings against two of the Defendants, and the first appellate decision to consider the scope of the ‘expediency’ requirement under s. 25.

D’Aloia v Persons Unknown & Ors

Colette successfully defended the leading Thai crypto exchange at the High Court trial in these proceedings, in which the Claimant was the victim of a crypto scam and sought recovery from crypto custodial wallet providers, where he could not identify the fraudsters. He brought claims against the exchanges, which he alleged were ‘off ramps’ for his digital assets used by the fraudsters, as constructive trustees, on a proprietary restitutionary basis, and in unjust enrichment, all of which failed. The case was well-publicised during interlocutory proceedings, as the first instance of service via NFT being permitted in the English courts. This was the first crypto fraud case of its kind to go to trial in the jurisdiction; the judgment is the leading English decision on crypto fraud claims, including being the first to accept a digital asset as a form of property.
